TERMS OF USE

1. THESE TERMS

Party.exe (“the app”) is developed by Sm4rtie and published by Faisal El Mais (“we”, “us”). By downloading or using the app you agree to these terms and to our Privacy Policy. If you downloaded the app from the App Store, Apple's standard Licensed Application End User License Agreement also applies; if from Google Play, the Google Play Terms of Service also apply. If these terms and the store's terms conflict, the store's terms apply to the store's part.

2. WHO CAN USE PARTY.EXE

• You must be 13 or older. The app asks for a month and year of birth the first time it opens.
• If you are under 18 (or under the age of adulthood where you live), please go through these terms with a parent or guardian.
• The optional AI assistant, when available, is only offered to players the age check places at 16 or over.

3. YOUR LICENCE TO USE THE APP

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Party.exe on devices you own or control, for your own non-commercial entertainment. The app and everything in it - the games, questions, word lists, artwork, sounds, text and code - belong to us or our licensors. The pixel font Press Start 2P is used under the SIL Open Font License.

4. PLAYING FAIR AND SAFELY

Please don't:

• copy, modify, decompile, reverse-engineer or redistribute the app, except where the law specifically allows it;
• sell, rent or charge others for access to the app;
• interfere with, overload, or try to get around the limits or safety checks of our server or the AI assistant (for example with automated requests);
• use player names in Party Mode, or messages to the AI assistant, to bully, harass or upset anyone.

Physical play

Many games involve fast tapping and passing a phone around a group. Hold the phone securely, mind the people and things around you, and take breaks. We are not responsible for a phone that is dropped or thrown.

Flashing lights

Some games use flashing colours and fast animation. A very small number of people may have seizures triggered by flashing lights. If you or anyone in your group has epilepsy or has had a seizure, check with a doctor before playing. Stop playing at once if you feel dizzy or unwell. Settings > Reduced Motion and Reduced Effects tone down movement and effects.

5. THE AI ASSISTANT (WHEN AVAILABLE)

• The assistant is an AI, not a person. Its replies are written automatically by a model from OpenAI and can be wrong or incomplete. Don't rely on them for anything important, and never treat them as professional, medical, legal or safety advice.
• It only answers questions about Party.exe. Its messages are checked for safety, but no filter is perfect - use REPORT on any reply that is wrong, unsuitable or upsetting.
• Never share personal details with it - your name, address, school, phone number, email, social media or passwords.
• You must not use it to try to produce harmful, hateful, sexual, violent or otherwise unsuitable content, or to get around its rules.
• Open-ended questions are limited per day, with a short wait between them. We may change those limits, pause the assistant, or switch it off at any time - for example to keep it safe or its costs under control. The games and the offline Game Help keep working either way.

6. PRICE

Party.exe is free, and nothing can be bought in it. If a paid feature (such as a future “Party.exe Pro”) is ever offered, it will be optional, its price and terms will be shown by the App Store or Google Play before you pay, and these terms will be updated first.

7. CHANGES AND AVAILABILITY

We may update, change or remove games and features, and may stop offering the app. Seasonal games (Halloween and Christmas) are only available during their events, and the dates can change from year to year. Online features depend on our server and on other companies' services and may sometimes be unavailable. Most of the app works offline.

8. OUR RESPONSIBILITY TO YOU

We work hard to make Party.exe safe and fun, but the app is provided “as is”, without guarantees that it will always be available, error-free or suitable for a particular purpose. To the extent the law allows, we are not liable for indirect or unforeseeable loss, or for loss caused by events outside our reasonable control. Nothing in these terms limits liability that cannot be limited by law, or affects your statutory rights as a consumer.

REVIEW: have this section checked against consumer law in the places the app is offered.

9. ENDING THESE TERMS

You can stop using Party.exe at any time by deleting it. If you seriously or repeatedly break these terms, we may stop your access to online features such as the AI assistant.

10. LAW

These terms are governed by the laws of REVIEW: governing law and courts (for example the United Arab Emirates, and the emirate). If you live elsewhere, you keep the protection of any mandatory consumer laws where you live.

11. CHANGES TO THESE TERMS AND CONTACT

If we change these terms, we will update this page and the date at the top; the app's own copy (Settings > Terms of Use) is updated with the next version. If you keep using the app after a change, the new terms apply.
